Em Junho de 2014 estou de volta a Portugal, regresso a Lisboa e a Braga, com um pé na Holanda e outro bem maior no meu País. E estou pra lá de radiante, estou pra lá de feliz. Sinto-me concretizada e a pessoa mais abençoada do mundo.

Por isso, queridos, queridos amigos, que há tanto tempo esperam por mim pacientemente e pela minha presença, aí estarei, por mim, por vocês, para alegrar os vossos dias e espantar a depressão nacional.

Regresso com as melhores condições possíveis, com uma gratidão enorme para com os Recursos Humanos da empresa para a qual trabalho, especialmente para com os Recursos Humanos Portugueses que me mostraram o caminho de regresso a casa.

Mais gratidão ainda para com as minhas chefias Holandesas, que têm uma capacidade extraordinária para lidar e entender os trabalhadores que lhes fazem o dia a dia mais leve. Muitíssimo obrigada ao Michiel, à Ingrid e ao Remco, porque são pessoas extraordinárias, com um coração do tamanho do mundo e com uma confiança em mim que não tem espaço no entendimento do comum mortal.

Vou continuar a ajudar quem queira passar pela experiência de ser emigrante, esperando sempre que o façam temporariamente, e rezando para que tenham as mesmas (ou maiores) oportunidades que eu e que o Universo lhes traga única e exclusivamente o melhor para si e para as suas famílias.

Maybe you’ve heard of the 30 percent ruling and want to benefit, but what is it and how does it work? Finsens’ tax experts explain the rules of the 30 percent ruling for expats in the Netherlands.

The 30 percent ruling
Since 2012, the conditions for eligibility have changed.  We take you through the new rules step by step.

What is the 30 percent ruling?The 30 percent reimbursement ruling is a tax advantage for foreign employees working in the Netherlands. If a number of conditions are met, the employer is allowed to grant a tax free allowance amounting to 30 percent times 100/70 of the gross salary subject to Dutch payroll tax. This results in a maximum (effective) tax rate of approximately 36.4 percent. The tax free allowance is considered a compensation for the expenses that a foreign employee has by working outside his or her home country.

Conditions
To be eligible for the 30 percent ruling the following conditions have to be met:

  • The employee works for an employer liable to withhold Dutch payroll tax on the employee’s salary.
  • Employer and employee have to agree in writing that the 30 percent ruling is applicable.
  • The employee has to be transferred from abroad to a Dutch employer or has to be recruited from abroad by a Dutch employer;
  • The employee did not reside within 150 kilometres from the Dutch border for the last 18 out of 24 months at the time of hiring;
  • The employee’s taxable (!) salary (roughly the gross salary reduced with the tax free reimbursement under the 30 percent ruling) is at least EUR 35,000 per annum.
  • The employee needs to have expertise which is scarcely available in the Netherlands.


Flexibility of the salary requirement

To be eligible, the employee needs specific skills that are scarce on the Dutch labour market. The ‘specific skills’ requirement of the old ruling has been replaced. Under the new legislation specific skills are measured by a threshold which is placed at EUR 35,000 taxable. This opens up the possibility to claim the ruling for people with a gross salary of, for example, EUR 40,000 and pay out only EUR 5,000 as a tax free reimbursement. In this situation the employee will still meet the EUR 35,000 taxable salary requirement.

PHD and masters graduates
Less strict rules apply for PHD and masters graduates younger than 30 years:

  • The minimum salary requirement is EUR 26,605 taxable.
  • If the PhD was completed in The Netherlands, the requirement of “being recruited from abroad” does not have to be met if the candidate is hired within a year of completing his or her studies.


Scientific researchers and medical specialists in training

There is no minimum required salary for scientific researchers who are employed by a university or a research institution that is subsidised by the government. Medical specialists in training also have no minimum required salary.

Scarcity
The requirement regarding scarcity on the labour market will be deemed to be met if the minimum salary requirement is met. The Ministry of Finance indicated however that for sectors where every candidate meets the minimum salary requirement, the scarcity test will still be applied.

Duration
The maximum duration of the 30 percent ruling is eight years. Any period spent in the Netherlands over the last 25 years will be used to reduce the maximum duration of the 30 percent ruling.

Financial consequences
Having read the above conditions, you may see that you are eligible for the ruling, but what does it actually mean?

The salary you agreed on will be reduced by a maximum of 30 percent. In return you will receive this percentage as a reimbursement for expenses. This is the most common way as it will not influence the salary burden for the employer. However, the employer is not obliged to pass on the advantage of the ruling to the employee. In practice it is possible for the employer to partially or fully take the benefit.

Application
Lowering the taxable income will most likely have implications for your potential unemployment or disability benefits, since these benefits are based on your taxable salary. The tax authorities require that both employer and employee are aware of these consequences. Therefore the application for the 30 percent ruling has to be done by both employer and employee and an agreement in writing is necessary. This can be done by means of a clause in your employment contract or as an addendum to the employment contract.

What is considered to be ‘salary’?

This has been a major discussion point over the last few years. Of course, your gross salary is considered to be salary, but what about your bonus, holiday allowance, company car, redundancy settlement or any other benefits in kind?
Basically, your ‘regular employment income’ is the basis for calculating the 30 percent tax-free reimbursement. There are regulations regarding pension premiums, but your bonus, holiday allowance, benefits in kind and company car all fall under the ruling. Other benefits
As well as having 30 percent of your salary paid tax free, there are other benefits.

Partial non-resident
Under the 30 percent ruling you can opt for ‘partial non-residency status’. Even while residing in the Netherlands, you will be considered to be a non-resident tax payer in Box 2 and Box 3 upon choosing the partial non-resident status. For Box 1 income you are still considered a resident tax payer. Consequently, you do not pay income tax on assets in Box 2 and 3 (except for real estate located in the Netherlands and substantial shareholding in a Dutch resident B.V.) but you are entitled to the partnership ruling in Box 1.

Driving Licence
If you have a foreign driving license, in most cases you will still have to redo your test in order to obtain a Dutch license. However, if you benefit from the 30 percent ruling, it is possible to switch your foreign driving license without retaking the test.

Points of attention

Redundancy
Under the new legislation, only payments that are done before the end of the employment relationship (thus the end of the ruling) fall under the 30 percent ruling. Severance payments are however explicitly excluded.  If you are made redundant, it is therefore important to:
1. have an outstanding bonus payment, holiday allowance, salary payment etc., transferred to your account as soon as possible, and;
2. have a breakdown of the redundancy package so it can be determined which part can be considered to be payment of your bonus and outstanding holiday allowance and which part is the actual severance payment.

Employment or self employed
To be eligible for the 30 percent ruling you have to be in an employment situation. If you are self-employed it will not be possible to claim the 30 percent ruling. However, if you set up a UK Limited Company or Dutch B.V. and become an employee of that company, you are considered to be in an employment situation and consequently eligible for the 30 percent ruling.

Retrospective Period
The 30 percent ruling will become effective in retrospect if the application is submitted within four months after the first day of employment. If the application is submitted after four months, it will become effective as of the first day of the month following the month of application.

Changing Jobs
If you change job you can reapply for the ruling, provided that you still meet the conditions and your new employment contract is signed within three months after termination of the previous. If you are benefitting from a 30 percent ruling that was issued before 1 January 2012, several special transfer rules apply when you find new employment. Especially people who do not qualify under the new legislation can meet certain grey areas in the law. If this is the case, we advise you to contact your tax advisor.

Pedrocas, diz-me lá, regressamos como exactamente?

O Pedro Lomba, que eu tive o prazer de conhecer pessoalmente há uns três anos atrás, e que me recomendou “O com os Holandeses” do J. R. de Carvalho (e só por isso hei-de agradecer-lhe eternamente, mas talvez só por isso) disse o seguinte ontem:

O secretário de Estado Pedro Lomba disse hoje em Lisboa que Portugal deve promover políticas de captação de talentos e adaptar-se ao “brain circulation”, uma migração de “valor qualificado”.
“A migração não deve ser regulada apenas pelo mercado de trabalho, o foco é também o talento, que é uma ideia que os espanhóis já puseram na lei. É o ‘brain circulation’ – estudantes, investigadores, técnicos qualificados, pequenos empresários. Uma migração em expansão de valor qualificado”, disse Pedro Lomba, secretário de Estado adjunto do ministro adjunto e do Desenvolvimento Regional, durante a apresentação do Relatório sobre Migrações 2013 da OCDE, analisado hoje por académicos na Fundação Luso Americana para o Desenvolvimento, em Lisboa.

Ora Pedro, não sendo eu uma representante da investigação ou dos estudantes, mas tendo vários amigos nessa área, faço-te algumas perguntas:

– Os Espanhóis, ou os Portugueses, na dita captação de migração de valor qualificado, prevêem contratos de trabalho tal como existem na Holanda? Ou vão continuar a promover a migração baseada em magras bolsas atribuídas por alguns organismos Estatais que fazem de gente adulta e qualificada um eterno estudante, sem direito a serem reconhecidos pelas outras entidades como profissionais de direito? Simplificando: há contratos para que todos tenham direito a ter uma vida adulta com opção de pedir um empréstimo para compra de casa, carro e sairem de casa dos Pais? E fundo de desemprego para esta gente qualificada, há?

– O que é um técnico qualificado? Quais os critérios que vais definir para estabelecer que alguém é qualificado o suficiente para migrar para Portugal? Ou seja, serei eu qualificada o suficiente (tal como todos os outros que têm emigrado nos últimos anos, com CVs extraordinários) para “me captares de volta” para o meu País? Em caso afirmativo, explica-me então porque é que eu tenho que pedir encarecidamente que me aceitem de volta, em vez de me oferecerem trabalho em Portugal?
Ou só queres Chinocas?

– Por último, eu expliquei-te o que era a regra do 30% rulling Holandesa. Será que te lembras? E será que a vais aplicar? Isso sim seria interessante de ver. Isso sim seria ter absorvido alguma coisa do que eu e os meus amigos tão bem te explicamos e ensinamos. Isso sim teria feito a tua passagem pelo meu País de acolhimento válida e eu deixaria de pensar que desperdicei um fim de semana a soprar ao vento.

Seriously. Your shoes probably smell like rubber. That means they are bad quality. Your shoes aren’t sexy with that outfit. Don’t wear those. They don’t make your calves look nice. I could buy those for 5 euros in Portugal.

3. They actually conquered lots of shit or something like that
Portugal was an empire! A big one. We discovered more than Brazil – we promise! Those British just stole our glory from us.

4. If you want to go to the beach, go to Portugal
We have 3 of the best beaches in the world. In the world. Why don’t they teach you these things in school.

5. Portuguese is the 6th most spoken language in the world

We understand Italian, French, and Spanish. It is just because they are all like Portuguese. Brazilians – they speak cute Portuguese. It is only funny if you speak Portuguese.

6. Walking too fast is rude
You are walking too fast. Life is meant to be enjoyed. Slow down. It is rude to walk in front of me, walk beside me.

7. The play-by-play is required
Where are you going? What are you doing? Who are you texting? What are you cooking?

8. Hair Conditioner and Air Conditioner are pronounced the same
We just don’t pronounce the “H”. The author would here like to point out that if you say you bought “air” conditioner and you mean hair conditioner, English native speakers will be very very confused.

9. It’s Lisboa

Not Lisbon. Lish-bow-ah. Say the city properly.

10. Pastries are better and more proliferous in Portugal 

You will walk into a shop and the walls will be lined with pastries and they all cost like 50 cents. O you get a coffee with this too and not like this North American watered down thing, real coffee

Tenho vergonha

Tenho muita vergonha de não saber até hoje que existiam Balneários Públicos e de ficar chocada com a solidão e a tristeza destas pessoas. Não me deveria chocar porque eu devia ver estas pessoas em vez de as aperceber invisíveis. Eu já devia saber isto. Se como eu não sabem e nunca viram, é seguir os links.

É o meu middle name.
– Vão-me emprestar um carro pra eu andar por Amesterdão quando ficar sem o meu em Novembro. Diz o ditado que não se emprestam carros nem mulheres, não é?
Pois a mim emprestaram-me um e eu estou eternamente grata ao bandalho que o vai fazer.
És o M-Á-I-O-R.
– Além disso consegui convencer os gajos da imobiliária a devolver-me o dinheiro que gastei nas fechaduras novas da casa. Como diz a minha amiga Pris, são 260 paus minina!! E isto já não foi sorte, foi persistência, eu sou literalmente um cão de fila, quando agarro o osso não largo. E além de explicar com técnica porque é que este prédio era inseguro, ainda encostei os tipos à parede ameaçando com colocar cartas em todas as caixas de correio a incitar os outros moradores a pedir-lhes uma indemnização por terem níveis de segurança tão ridículos. Coisa que eu era muito menina pra fazer, mas agradeço a quem quer que seja mais que tenha sido assaltado (sim, porque eu não acredito que os tipos me tiveram medo, eles devem ter tido é mais más experiências e foram forçados a mudar de ideias e planos) porque me poupou um ror de trabalho. ‘gradecida!
– Já vos disse que tenho um inquilino novo que é Chef de cozinha e que me ensina truques? Ah pois é bébé, isto depois do Manelinho foi sempre a subir porque escrevi claramente nos requisitos: um que não me pegue fogo à cozinha, por favor! E…. cheeeeck!!
– Ah, e pra somar a esta cereja no topo do bolo, tenho os melhores amigos à face da terra. Quinta vou pra Lisboa e fico com a Joaninha e Sexta vou pro Algarve com mais 2 malotas, ficar numa casa com dois dos meus melhores amigos E com PISCINA!! E sábado casa um amigo do coração e vão estar 25 graus em Faro. E domingo e segunda durmo em casa de outros amigos que também me acolheram de coração, este sem tecto em Lisbon city, ehehe.

Nota-se muito que vou a Lisboa outra vez? Estou um bocadinho pro desconcertadamente histérica, como quando se está apaixonada e se vai ver o dito cujo outra vez. Aquela coisa que se sente, o coração a saltar fora do peito, a boca do estômago a dar voltas da nervoseira, e uma felicidade inexplicável. De tal maneira que hoje quando saí pra passear os cães de cachecol e senti falta dumas luvinhas, nem me chateei nem nada.

E sim, oh pá, eu tenho um cú de sorte que não posso com ele, graças a Deus!

As minhas origens são rock and roll!

E quem nunca dançou um vira não sabe o que perde, e falo muito a sério. Quando andava no liceu tinha uma turma carregada de betos e o nosso Professor de Educação Física decidiu dar-nos uma lição que até hoje agradeço. Ele deu-nos aulas de danças tradicionais Portuguesas, ou seja, Folclore.
Na primeira aula resmungou tudo. Na segunda já só quem tinha faltado à primeira é que resmungava e na terceira aula a malta fugia dos campos de basketball e de futebol pra vir dançar o Vira e o Malhão. Betos, cheios de nove horas, tudo a dançar e a rir com gosto. Toda a minha gente batia o pezinho.
Os Origem Tradicional são um grupo de malta com um espírito muito jovem que percorre o País a cantar músicas tradicionais Minhotas e Senhores, cantam que s’a fartam, animam até um morto!

Já não se fazem emigrantes como antigamente!

GRAÇAS A DEUS!!

É o caso de Filipa Almeida, 32 anos, arquitecta, que depois de seis anos em Berlim decidiu voltar para Portugal, porque não se imaginava a envelhecer fora do seu país. Fundou uma empresa e teve uma filha. Não pensa em voltar a emigrar.

Também Ricardo Silva, dentista, 28 anos, optou por recusar uma proposta de emprego em Angola, depois de ter encontrado trabalho em Portugal. Não quis abdicar da relação com a família e com os amigos. Os afectos também contam.
